Pharmacy Firm Alleges PCN Double Standards Over Kubwa Location

Eleosgate Pharmacy and Stores Limited has accused the Pharmacy Council of Nigeria (PCN) of corruption and selective enforcement of its regulations after its 2023 application to operate a retail pharmacy in Kubwa, Abuja, was rejected for allegedly violating the 200-metre distance rule—only for another operator to receive approval at the same premises nearly two years later.
The allegation is contained in a petition dated 4 February 2026, submitted through the company’s lawyers, Lawrence Alabi & Co (Victory Chambers). Eleosgate accused the PCN’s Pharmaceutical Inspectorate Committee (PIC) of applying regulatory standards inconsistently in the approval of pharmacy locations within the Federal Capital Territory.
According to the petition, Eleosgate sought approval on 24 May 2023 to operate at Bahamas Plaza, Plot L35 FCDA Scheme, Cardinal John Onaiyekan Street, Ext. III, Kubwa. While the application was acknowledged, it was later declined on the grounds that the site fell within 200 metres of an existing pharmacy.
The company, however, said the rejection was issued without any disclosed measurement records, inspection reports, or documented site assessment to support the decision.
The dispute resurfaced after Eleosgate discovered that another pharmaceutical operator had since been approved to operate from the same Bahamas Plaza, despite no changes to the building, its surroundings, or its distance from neighbouring pharmacies.
Describing the development as troubling, Eleosgate said the conflicting decisions point to regulatory inconsistency and possible corrupt influence, warning that such practices undermine fair competition and public confidence in pharmaceutical oversight.
As of the time of filing this report, the PCN had not responded to the allegations.
